Sportgerichte im Amateurfußball

The doctoral project "Sportgerichte im Amateurfußball" pursues the goal of using a comparative law approach to carry out an analysis of sports and criminal jurisdiction with special consideration of theories of the purpose of punishment and research on the effects of punishment. In addition, the acceptance of sports court proceedings and the effects of sports court sanctions after incidents of violence and discrimination in amateur football are to be criminologically examined.

In this thesis, the association sports jurisdiction is first examined and analyzed from a comparative legal approach with regard to legal references to the ordinary, but especially to the criminal jurisdiction. The main focus of the analytical comparison will be on the principles of criminal law, theories of the purpose of punishment and sanctioning practice. The research is guided by the question of whether football associations, insofar as they make use of criminal law methodologies within the framework of the association's criminal power and association sanctions, must not also be measured against the principles of state law.

In a further step, the acceptance of the sports courts and the effects of the sanctions imposed by the sports courts on the players will be examined with the help of a sociological approach. Methodologically, this will be done using focus group interviews.
Based on the results, the possibilities offered by sports jurisdiction to effectively counter discrimination and violence in amateur football and to contribute to meaningful conflict resolution will be asked.
