Polizeilicher Schusswaffengebrauch in Deutschland

[Police Use of Firearms in Germany ]

The dissertation project examines the use of firearms by the police as the ultimate means of coercion of the state's monopoly on the use of force. The legal framework of police and criminal law that regulates this use and its possible justification under criminal law is analyzed in detail.

In addition, cases of police use of firearms are analyzed according to the personal and situational characteristics of the persons involved. Comparable cases without the (fatal) use of firearms are also taken into account. To this end, cases involving the use of firearms are examined by analyzing files and the media, and interviews are conducted with experts. This comparative analysis is intended to shed light on the factors that may contribute to the non-lethal use of firearms in certain situations. International studies on the use of firearms by the police will be taken into account and analyzed with regard to their relevance and transferability to German conditions.

The aim of the research is to understand the underlying dynamics and decision-making processes that lead to the use of firearms. The findings will be used to develop recommendations that can improve police training and action strategies as well as legal regulations. Ultimately, the research should help to increase safety and reduce the risk of fatal incidents.
